Terms of Service

1. Company and Contact Details

Fairways Consulting S.L. provides Totalis as a SaaS (Software as a Service) product. For queries, support, or cancellations, contact legal@totalis.ltd.

2. Description of the Service

Totalis provides:

• Employee records: contracts, compensation, documents, and reporting lines.
• Time tracking and absences: clock-in/out, project tracking, holiday and leave management.
• Company policies: publishing and tracking acceptance, with an audit trail.
• Invoicing: quotes, invoices, and credit notes with numbering series.

3. Registration and Access

• Create an account with true and up-to-date information.
• You are responsible for keeping your credentials confidential.
• We may suspend or terminate access for breach of these terms, misuse (scraping, resale of data, reverse engineering), or for legal reasons.

4. Plans, Subscriptions, and Payments

• Basic: £9/month + £2/user. Up to 100 invoices per year and up to 10 project workflows.
• Advanced: £17/month + £3/user. Up to 1,000 invoices per year and unlimited projects.
• Custom: tailored, on request — custom invoicing volume, multi-company support, and bespoke API integrations.

Monthly subscription, auto-renewing. Payments processed via secure payment providers. Prices are shown in pounds sterling as a fixed-rate conversion from our euro list prices, not a live exchange rate.

5. Permitted Use and Prohibitions

Legitimate business use for managing your organisation's employees, time, policies, and invoicing.

Prohibited: resale of data, bulk scraping, interfering with the service, or infringing the rights of third parties.

6. Intellectual Property and Data

• Totalis and its content are the exclusive property of Fairways Consulting S.L.
• You retain ownership of your organisation's data (employees, documents, invoices) entered into the service.
• When processing your employees' personal data, Totalis acts as processor and your organisation as controller — see our Privacy Policy for details.

7. Warranties and Liability

The service is provided "as is" and "as available".

We are not liable for losses, damages, or decisions based on the service, except where applicable law does not permit such exclusion.

Liability is limited to the amount paid in the preceding 12 months.

8. Termination

• Cancel at any time from your account settings; access continues until the end of the month.
• We may terminate for serious breaches, with notice (except in urgent cases).
• After termination, your organisation's data is deleted within 30 days (except where we are legally required to retain it).

9. Governing Law and Jurisdiction

These terms are governed by Spanish law (Law 34/2002 on Information Society Services and applicable consumer regulations, where relevant), and disputes are submitted to the Courts of A Coruña, Spain.

If you are a consumer resident in the United Kingdom, this choice of law does not deprive you of the protection afforded by the mandatory consumer-protection provisions of the law of your country of residence, and nothing in these terms limits your right to bring proceedings before the courts of your own jurisdiction.

10. Changes

We may update these terms by notifying you by email or on the website. Continued use of the service constitutes acceptance.
